Supreme Court rules on Special Education Case

Last Friday, the BC Supreme Court gave judgment in the case BC (Ministry of Education) v. Moore, dealing with the education of a North Vancouver student with dyslexia in the early 1990s.  The Supreme Court decision overturned the decision of the Human Rights Tribunal that held that the Ministry of Education and the North Vancouver Board of Education had discriminated against the student by not providing appropriate services. The Tribunal had ordered the Ministry of Education to change funding and accountability structures for special education and had awarded damages including private school tuition. Further analysis will be forthcoming from BCSTA Legal Services.
