Appeals

Almost every issue is more complex than it appears on the surface. The day-to-day running of the district, including decisions relating to students, falls within the authority of the superintendent. The School Act provides an exception when a staff decision has a significant impact on the education, health or safety of a student. In these cases, the student or parent has a right to appeal to the board of education. Boards are required to have a process for these appeals. Most require appellants to go through a process of initially trying to resolve problems with school and district staff. Many issues are resolved this way.

If a matter that significantly impacts a student is unresolved, the board has a responsibility to hear and decide appeals from students, parents, employees and the public in relation to decisions made by school district staff. Board decisions are final, except for certain types that can be appealed to the provincial superintendents of achievement in the Student Appeals Branch.

Superintendents of achievement can refer matters to mediation or adjudication, dismiss all or part of an appeal, or suspend implementation of a board appeal decision until the further appeal is dealt with.
